Please read these Terms of Service (“Terms”) carefully before using the Noctumbra.art website and purchasing artworks, prints, or merchandise. By accessing or using our Service, you agree to be bound by these Terms.
1. Acceptance of Terms
The Service is owned and operated by Noctumbra (Tibor Balog) (the “Artist,” “We,” “Us,” or “Our”), based in Serbia. These Terms apply to all visitors, users, and others who access or use the Service. If you disagree with any part of the terms, then you may not access the Service.
2. Intellectual Property & Copyright
2.1 Ownership of Artworks
All content published and made available on the Service, including all digital images, visual art, text, graphics, logos, and all Original Artworks, Limited Edition Prints, and designs on Merchandise, are the sole property of the Artist and are protected by copyright and intellectual property laws of the Republic of Serbia and applicable international conventions.
2.2 Purchase Does Not Transfer Copyright
The purchase of an Original Artwork or Limited Edition Print does not transfer the copyright of the artwork to the buyer. The Artist retains all rights to reproduce, distribute, or create derivative works from the artwork, including the right to produce prints, merchandise, and digital copies, unless an explicit, signed written agreement transferring commercial rights has been made.
2.3 Permitted Use
Users may view and download the content for personal, non-commercial use only. Any reproduction, redistribution, modification, public display, or commercial exploitation of any part of the Service content without the express written permission of the Artist is strictly prohibited.
3. Products and Sales
3.1 Product Information
We strive to display accurate colors and images of our products. However, we cannot guarantee that your device’s display of any color will be accurate. All sizes and dimensions are approximate.
3.2 Pricing and Payment
Prices for our products are subject to change without notice. We reserve the right to refuse any order you place with us. By purchasing, you warrant that all payment details provided are valid and correct.
3.3 Original Artworks vs. Prints
- Original Artworks are unique, one-of-a-kind items.
- Limited Edition Prints are individually numbered and signed reproductions. Once the stated edition quantity is sold, no further prints of that image will be produced.
- Merchandise (POD Products) are printed with designs related to the aesthetic style of the Artist.
4. Shipping and Delivery
Shipping and delivery are subject to our separate Shipping Policy. We are not responsible for delays caused by postal services, customs processes, or force majeure events after the item has been dispatched. The buyer is responsible for any import duties, taxes, or customs fees levied by their country upon arrival.
5. Returns and Refunds
Returns, refunds, and exchanges are governed by our separate Return & Refund Policy. Please review this policy prior to purchase, as return eligibility varies significantly between Original Artworks, Limited Edition Prints, and Merchandise.
6. Limitation of Liability
The Service and all products are provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, the Artist shall not be liable for any direct, indirect, incidental, punitive, or consequential damages resulting from your use of the Service or the products purchased.
7. Governing Law and Jurisdiction
These Terms shall be governed and construed in accordance with the laws of the Republic of Serbia, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising out of or relating to these Terms will be brought exclusively in the courts located in Sombor.
8. Changes to Terms
We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. We will try to provide at least 30 days’ notice before any new terms take effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
